2. ACCEPTANCE OF TERMS

2.1 Agreement to Terms

By accessing imbastudio.ca or using any of our services, you confirm that:

  • Submit false, misleading, or fraudulent project inquiries or orders
  • Reverse engineer, decompile, or disassemble our proprietary technologies

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Open-Source Commitment

IMBA STUDIO champions open-source manufacturing and knowledge sharing:
Open-Source Designs:
  • Designs explicitly marked as "open-source" are released under Creative Commons licenses (typically CC BY-SA 4.0 or CC BY-NC-SA 4.0)
  • You are free to use, modify, and share these designs subject to license terms
  • Attribution Requirement: You must credit IMBA STUDIO as the original creator and provide a link to imbastudio.ca
  • Share-Alike Requirement: Derivative works must be shared under the same license
  • Commercial use may be restricted depending on the specific license (refer to individual design documentation)
Manufacturing Knowledge:
  • Techniques, tutorials, and manufacturing knowledge shared on our platform are freely accessible
  • We encourage the democratization of manufacturing knowledge and welcome community contributions

4.2 Proprietary Content

The following remain the exclusive property of IMBA STUDIO:
  • Trademarks: "IMBA STUDIO" name, logo, and associated branding
  • Website Content: Text, graphics, photos, videos, and user interface design
  • Proprietary Designs: Products not explicitly marked as open-source
  • Software and Tools: Custom tools, algorithms, and software developed by IMBA STUDIO
Unauthorized use, reproduction, or distribution of proprietary content is strictly prohibited and may result in legal action.

4.3 User-Generated Content

Custom Projects:
  • Designs, specifications, and intellectual property you provide for custom manufacturing projects remain your property
  • You grant IMBA STUDIO a limited license to use your designs solely for manufacturing purposes
  • With your explicit permission, we may showcase completed projects on our website and social media for promotional purposes
Community Contributions:
  • By submitting designs, feedback, or content to IMBA STUDIO, you grant us a non-exclusive, royalty-free license to use, modify, and distribute your contributions
  • You retain ownership of your original work

5. PRODUCTS AND SERVICES

5.1 Product Availability

  • Products are subject to availability and may be discontinued or modified without notice
  • We reserve the right to limit quantities or refuse service at our discretion
  • Product images and descriptions are provided for reference and may vary slightly from actual items due to the nature of 3D printing

5.2 Pricing and Payment

  • All prices are displayed in Canadian Dollars (CAD) unless otherwise stated
  • Prices are subject to change without notice
  • Applicable taxes (HST/GST) will be added at checkout
  • Payment must be received in full before order processing
  • We accept major credit cards, PayPal, and other payment methods as indicated at checkout

5.3 Orders and Fulfillment

Standard Products:
  • Processing time: 3-7 business days from order confirmation
  • Shipping time: Varies based on location and selected shipping method
  • You will receive order confirmation and tracking information via email
Custom Manufacturing Projects:
  • Require submission of a project inquiry through our website
  • Timeline and pricing provided upon project review and approval
  • Custom orders may require deposits or milestone payments
  • Modifications during production may incur additional costs and delays

5.4 Quality Commitment

At IMBA STUDIO, every product undergoes rigorous quality inspection:
  • We reprint or refund defective products at no additional cost
  • Manufacturing with sustainable materials and ethical practices
  • Transparent communication throughout the production process

6. CUSTOM MANUFACTURING SERVICES

6.1 Project Inquiry Process

  1. IMBA STUDIO reviews feasibility, timeline, and provides a quote
  1. Upon acceptance, a production agreement is established
  1. Milestone updates provided throughout manufacturing

6.2 Client Responsibilities

  • Provide accurate, complete specifications and design files
  • Respond promptly to clarification requests
  • Review and approve prototypes or samples when required
  • Understand that 3D printing tolerances and material properties may affect final results

6.3 Intellectual Property in Custom Projects

  • Your designs remain your intellectual property
  • IMBA STUDIO will not reproduce or share your designs without permission
  • Non-disclosure agreements (NDAs) available upon request for sensitive projects

7. SHIPPING AND DELIVERY

7.1 Shipping Options

  • Local Delivery: Available within the Greater Toronto Area (GTA)
  • Canada-Wide Shipping: Via Canada Post and courier partners
  • Zero-Emission Options: Local bicycle courier and eco-friendly shipping available
  • International Shipping: Available upon request; customs and duties are the customer's responsibility

7.2 Shipping Costs

  • Calculated at checkout based on weight, dimensions, and destination
  • Free shipping may be offered on orders exceeding specified thresholds

7.3 Delivery Timeline

  • Standard delivery: 5-10 business days within Canada
  • Expedited shipping available at additional cost
  • Delays due to weather, customs, or carrier issues are beyond our control

7.4 Risk of Loss

Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for lost or stolen packages after delivery confirmation.

8. RETURNS, REFUNDS, AND CANCELLATIONS

8.1 Return Policy

Standard Products:
  • 30-day return window from date of delivery
  • Products must be unused, in original condition, and in original packaging
  • Return shipping costs are the customer's responsibility unless the product is defective
  • Refunds processed within 7-10 business days of receiving returned items
Custom Products:
  • Custom-manufactured products are generally non-refundable and non-returnable
  • Exceptions made for defects or significant deviations from approved specifications
  • Issues must be reported within 7 days of delivery

8.2 Defective Products

If you receive a defective or damaged product:

  1. Provide photos and description of the defect
  1. We will offer a replacement, reprint, or full refund at our discretion

8.3 Order Cancellations

  • Before Production: Full refund minus any processing fees
  • During Production: Partial refund based on work completed
  • After Shipping: Standard return policy applies

9. LIMITATION OF LIABILITY

9.1 Product Use and Disclaimer

IMBA STUDIO products are provided "AS IS" without warranties of any kind, express or implied. We disclaim all warranties, including but not limited to:
  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Uninterrupted or error-free operation

9.2 Liability Limitations

To the maximum extent permitted by law, IMBA STUDIO shall not be liable for:
  • Indirect, Incidental, or Consequential Damages: Including lost profits, data loss, or business interruption
  • Product Misuse: Damages resulting from improper use, modification, or negligence
  • Third-Party Services: Actions of shipping carriers, payment processors, or other third parties
  • Maximum Liability: Our total liability shall not exceed the purchase price of the product or service in question

9.3 Specific Use Cases

3D Printed Products:
  • Not intended for medical, safety-critical, or load-bearing applications unless explicitly stated
  • Material properties vary based on printing parameters and environmental conditions
  • Users are responsible for determining suitability for intended applications

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless IMBA STUDIO, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
  • Your violation of these Terms
  • Your misuse of our products or services
  • Your infringement of third-party intellectual property rights
  • Your violation of applicable laws or regulations
